Privacy Policy

This Privacy Policy describes how Atlas & Form (“Atlas & Form,” “we,” “us,” or “our”) collects, uses, protects, retains, and discloses personal information in connection with the Atlas & Form website at atlasandform.com (the “Site”), our contact and intake forms, our communications, and our digital marketing, web development, and software development services (together, the “Services”). “You” and “your” refer to visitors, clients, prospective clients, and other people who interact with us. By using the Site or providing information to us, you acknowledge the practices described here. If you do not agree, please do not use the Site or provide information to us. We may update this Policy and will post the updated version with a new “Last Revised” date.

1. Scope of this policy

This Policy applies to personal information collected through the Site and its forms. Our email, phone, SMS, and project-portal communications. And our onboarding, project, billing, and support interactions. It does not cover third-party websites or services we do not control, even if linked from the Site.

2. Personal information we collect

Information you provide: identifiers and contact information (name, email, phone, mailing address, business name, job title); project and inquiry information (services of interest, budget, timeline, and details you share in a form, call, or brief); account or portal credentials, where applicable. Billing information (billing contact, invoices, payment status, and payment-related metadata); Client Materials you provide for a project. And communications with us. Collected automatically on the Site: IP address, device and browser type, pages visited, links clicked, referring/exit pages, dates and times, and cookie, session, and log data. From third parties: our payment processor, analytics and advertising platforms, and providers that help us run the business, and information you authorize others to share with us. We do not intentionally collect sensitive personal information through the Site and ask that you not send it through our forms or by unsecured email.

3. How we use personal information

We use personal information to: respond to inquiries and provide proposals. Deliver, manage, and improve the Services and the Site. Create and manage accounts and project communications. Process payments and manage billing. Send service and administrative messages and, where you opt in, marketing messages you can unsubscribe from. Perform analytics, measure our own marketing, and improve our offerings. Detect, prevent, and respond to fraud, abuse, security incidents, and technical issues. And comply with law and enforce our agreements.

4. SMS and text messaging

If you provide a mobile number and opt in, we may send conversational and service-related text messages, such as project updates, scheduling, and document or information requests. Reply STOP to opt out and HELP for help. Message and data rates may apply. Message frequency varies. Consent to receive SMS is not a condition of purchasing or using the Services. Where SMS consent is collected through a form, the consent checkbox is optional, unchecked by default, and not required to submit the form. We do not sell or share mobile numbers or SMS consent with third parties or affiliates for their marketing.

5. Email and phone communications

If you provide your email or phone number, we may contact you about inquiries, projects, scheduling, billing, support, and administrative or legal notices. Marketing emails include an unsubscribe option. Even if you opt out of marketing, we may still send service-related and transactional messages. We do not sell email addresses or phone numbers or share them with third parties for their independent marketing.

6. How we share personal information

We do not sell personal information and do not share it for cross-context behavioral advertising. We disclose personal information only as needed to: service providers and subprocessors that operate parts of our business. Professional advisors such as lawyers and accountants. Authorities when required or permitted by law or to protect rights, safety, and security. And a successor in a merger, acquisition, or sale of the business, subject to this Policy. Service providers may use personal information only to provide services to us, not for their own marketing.

7. Service providers and subprocessors

To run the Site, communications, and Services, we use providers that may include website hosting and cloud infrastructure. Analytics. Email, SMS, and CRM tools. Payment processing. Advertising and social platforms (for our own marketing); scheduling and e-signature. Project management and document storage. And security, logging, and productivity tools. We do not authorize these providers to use personal information for their own marketing.

8. Client materials and data we process for clients

You retain your rights in the Client Materials and data you provide, and we do not claim ownership of them. You authorize us to host, use, process, and display them as reasonably necessary to provide the Services, maintain security, and comply with law. Where we process personal information about a client’s own customers, contacts, employees, or other individuals on the client’s behalf, the client is the controller and we act as a service provider or processor, and, where required, the parties enter a data processing addendum. Clients are responsible for providing required notices and obtaining required consents for the data they direct us to process.

9. Artificial intelligence and automation

We may use AI and automation tools to help operate the Site and deliver the Services (for example, to draft, classify, summarize, or analyze). When we do, personal information may be processed by us or by providers acting on our behalf only as necessary for that purpose. We do not use client confidential information or Client Materials to train third-party AI models without notice and consent or as otherwise permitted by law and agreement. AI-assisted outputs are reviewed by our team before delivery.

10. Payments and billing

When you pay us, we collect billing contact information, invoice and transaction details, and payment-related metadata. Payment-card details are handled by our third-party payment processor and are not stored on our own systems. That processing is subject to the processor’s own terms and privacy practices.

11. Cookies and similar technologies

The Site uses cookies and similar technologies to operate and secure the Site, remember preferences, measure traffic and performance, and understand how visitors use the Site. Most browsers accept cookies by default. You can usually change your settings to remove or reject them, though some features may not work without them. Where we use non-essential, analytics, or advertising technologies, we provide any disclosures, consent options, or opt-outs required by law, and we honor recognized opt-out preference signals such as Global Privacy Control where applicable.

12. Analytics and advertising

We use analytics to understand and improve Site usage, and we may use advertising and retargeting technologies to promote our own Services, where permitted by law. We do not disclose client project information for third-party targeted advertising. Our Site is not designed to respond to “Do Not Track” signals. 13. Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, and alteration, which may include access controls, authentication, encryption where appropriate, monitoring, vendor review, and staff practices. No system can be guaranteed completely secure. If a breach of personal information occurs, we will notify affected individuals and regulators as and where required by law.

14. Data retention

We keep personal information for as long as reasonably necessary to provide the Services, maintain relationships and records, comply with legal, tax, and accounting obligations, resolve disputes, and enforce agreements. Different categories are kept for different periods based on purpose and legal requirements. If you request deletion, we will honor it where we are not required or permitted to retain the information. Deleted information may persist for a limited time in backups until overwritten.

15. Data transfers

Atlas & Form is based in the United States and operates the Site from the United States. If you interact with us from outside the United States, your information will be processed here, where privacy laws may differ from those in your location. Where required, we use appropriate safeguards for international transfers.

16. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to opt out of certain processing, and, in some states, to appeal a decision on your request. To make a request, contact us at team@atlasandform.com. We may need to verify your identity, and we may decline where the law permits. You may use an authorized agent where allowed. We will not discriminate against you for exercising your rights.

17. U.S. State and california privacy rights

Residents of California and of other states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut, Texas, Oregon, and others) may have the rights described above, including access, correction, deletion, portability, opt-out of sale/targeted advertising/certain profiling, and, where provided, appeal. We do not sell personal information or use it for cross-context behavioral advertising, and we do not sell or share mobile numbers or SMS consent. 18. EEA and UK rights

If you are in the European Economic Area or the United Kingdom, you may have rights of access, rectification, erasure, restriction, objection, and portability, and the right to complain to a supervisory authority. 19. Automated Decision-Making and children

We do not use personal information to make decisions producing legal or similarly significant effects about you through solely automated means. The Site and Services are intended for a general business audience and are not directed to children under 13, and we do not knowingly collect personal information from children under 13; if we learn we have, we will delete it as required by law.

20. Third-Party links

The Site and our communications may link to third-party sites and services with their own privacy practices, for which we are not responsible. Please review their policies before providing information to them.
